POGOJI POSLOVANJA IN PODATKI O PODJETJU


Pogoji poslovanja

Splošni pogoji so sestavljeni v skladu z Zakonom o varstvu potrošnikov (ZVPot).

S spletno stranjo www.gabione.si upravlja podjetje Žicteh d.o.o., ponudnik storitev e-poslovanja (v nadaljevanju »ponudnik«).

Splošni pogoji poslovanja obravnavajo delovanje www.quadrojet.com, pravice uporabnika ter poslovni odnos med ponudnikom in kupcem.

Dostopnost informacij

(povzetek zakonodaje)

Ponudnik se zavezuje, da bo kupcu vselej zagotovil naslednje informacije:

a) identiteto podjetja (ime in sedež podjetja, številka registra),

b) kontaktne podatke, ki uporabniku omogočajo hitro in učinkovito komunikacijo (e-pošta, telefon),

c) bistvene značilnosti blaga oziroma storitev (vključno s poprodajnimi storitvami in garancijami),

d) dostopnost izdelkov (vsak izdelek ali storitev, ki je v ponudbi na spletnem mestu, naj bi bil dostopen v razumljivem roku),

e) pogoje dostave izdelka ali izvršitve storitve (način, kraj in rok dostave),

f) vse cene morajo biti jasno in nedvoumno določene

g) način plačila in dostave,

h) časovno veljavnost ponudbe,

i) rok, v katerem je še možno odstopiti od pogodbe in pogojih za odstop; poleg tega tudi o tem, če in koliko stane kupca vračilo izdelka,

j) pojasnilo postopka ob pritožbi, vključno z vsemi podatki o kontaktni osebi ali službi za stike s kupci.

Ponudba artiklov

Zaradi narave poslovanja preko svetovnega spleta se ponudba www.craftsnake.com ažurira in spreminja pogosto in hitro.

Načini plačila

Ponudnik omogoča naslednje načine plačila:

  • Preko bančnega nakazila (Plačilni nalog UPN, direct bank transfer)

Ponudnik kupcu izda račun, z razčlenjenimi stroški. Kupoprodajna pogodba (naročilo) je v elektronski obliki shranjena na strežniku ponudnika.

Cene

Spletna cena velja za vse kupce spletne trgovine www.gabione.si. Vse cene vsebujejo DDV, razen če je izrecno napisano drugače. Cene veljajo v trenutku oddaje naročila in nimajo vnaprej določene veljavnosti.

Cene veljajo v primeru plačila z zgoraj navedenimi načini plačila, pod zgoraj navedenimi pogoji. Kljub izjemnim naporom, da bi zagotovili najbolj ažurne in točne podatke, se lahko zgodi, da je podatek o ceni napačen. V tem primeru, ali v primeru, da se cena artikla spremeni med obdelavo naročila, bo ponudnik kupcu omogočil odstop od nakupa, hkrati pa bo ponudnik kupcu ponudil rešitev, ki bo šla v obojestransko zadovoljstvo.

Kupoprodajna pogodba med ponudnikom in kupcem je sklenjena v trenutku, ko ponudnik potrdi naročilo (kupec prejme elektronsko sporočilo o statusu Naročilo potrjeno). Od tega trenutka so vse cene in drugi pogoji fiksirani in veljajo tako za ponudnika, kot za kupca.

Postopek nakupa

Kako naj pripravim naročilo?

Ponudnik vedno kontaktira naročnika na e-pošto ali kontaktno telefonsko številko, ki jo je posredoval za razjasnitev podrobnosti, pravilnosti naročila in načina dostave.

Ponudnik v dogovorjenem roku blago pripravi in odpošlje. Če kupec izbere dostavo preko Pošti, ima kurir vedno pri sebi telefonsko številko kupca, da ga lahko obvesti o času dostave ali morebitnih zamudah.

Pravica do odstopa od nakupa, vračilo blaga

Kupec ima pravico, da v 14 dneh, od prevzema blaga podjetju sporoči, da odstopa od pogodbe, ne da bi mu bilo potrebno navesti razlog za svojo odločitev. Šteje se, da je sporočilo pravočasno, če je pošiljka oddana v roku.

Razen če sta se pogodbeni stranki dogovorili drugače, potrošnik nima pravice do odstopa od pogodbe pri sledečih izdelkih:– za blago izdelano po naročilu posebej za kupca.

Edini strošek, ki bremeni potrošnika v zvezi z odstopom od pogodbe, je neposreden strošek vračila blaga. Slednjega mora vrniti podjetju najkasneje v 14 dneh po sporočilu o odstopu. Če je potrošnik odstopil od pogodbe, mu mora podjetje vrniti vsa opravljena plačila. Vračilo plačil mora podjetje opraviti takoj, ko je to mogoče, najkasneje pa v 14 dneh po prejemu sporočila o odstopu od pogodbe. Podjetje lahko zadrži plačilo, dokler ne prejme vrnjenega blaga ali dokler potrošnik ne pošlje dokaza, da je blago poslal nazaj, odvisno od tega, kateri dogodek se zgodi prej. Če je podjetje zamudilo z vračilom vplačil , mora potrošniku poleg zakonitih zamudnih obresti plačati še eno desetino prejetih plačil za vsakih dopolnjenih 30 dni zamude pri vračilu.

Vračilo blaga je možno v ohranjenem tržnem stanju (oznake, etikete, originalna embalaža, račun), brez znakov uporabe (odrgnine, umazanost, razpoke, itd.). Izpolniti morate anketo za vračilo/zamenjavo blaga, ki jo lahko dobite tukaj, in jo priložiti k blagu pri vračilu. Vračilo je možno preko Pošte Slovenija ali osebno (ob predhodnem obvestilu po tel. 06 861 1189) na naslov: Žicteh d.o.o., Sedlasek 74, 2286 Podlehnik, Slovenia.

Garancija

Artikli imajo garancijo, če je tako navedeno na garancijskem listu ali na računu. Garancija je veljavna ob upoštevanju navodil na garancijskem listu ter ob predložitvi računa. Garancijski roki so navedeni na garancijskih listih ali na računu.

Informacija o garanciji je navedena tudi na strani s predstavitvijo artikla. Če informacije o garanciji ni, artikel nima garancije ali pa podatek v tem trenutku ni znan. V slednjem primeru lahko kupec kontaktira ponudnika, ki bo zagotovil ažurno informacijo.

Uveljavljanje stvarne napake

  1. člen
  2. (1) Prodajalec mora potrošniku izročiti blago v skladu s pogodbo in odgovarja za stvarne in pravne napake svoje izpolnitve.

(2) Napaka je stvarna:

  1. če stvar nima lastnosti, ki so potrebne za njeno normalno rabo ali za promet;
  2. 2. če stvar nima lastnosti, ki so potrebne za posebno rabo, za katero jo kupec kupuje, ki pa je bila prodajalcu znana oziroma bi mu morala biti znana;
  3. 3. če stvar nima lastnosti in odlik, ki so bile izrecno ali molče dogovorjene oziroma predpisane;
  4. 4. če je prodajalec izročil stvar, ki se ne ujema z vzorcem ali modelom, razen če je bil vzorec ali model pokazan le zaradi obvestila.
  5. (3) Primernost blaga za normalno rabo se presoja glede na običajno blago enake vrste in ob upoštevanju kakršnihkoli prodajalčevih izjav o značilnostih blaga, ki jih je dal prodajalec ali proizvajalec zlasti z oglaševanjem, predstavitvijo izdelka ali navedbami na blagu samem.
  6. (4) Za odgovornost za stvarne in pravne napake se uporabljajo določbe zakona, ki ureja obligacijska razmerja, če ta zakon ne določa drugače.
  7. 37.a člen

(1) Potrošnik lahko uveljavlja svoje pravice iz naslova stvarne napake, če o napaki obvesti prodajalca v roku dveh mesecev od dneva, ko je bila napaka odkrita.

(2) Potrošnik mora v obvestilu o napaki natančneje opisati napako in prodajalcu omogočiti, da stvar pregleda.

(3) Obvestilo o napaki lahko potrošnik prodajalcu sporoči osebno, o čemer mu prodajalec mora izdati potrdilo, ali ga pošlje v prodajalno, kjer je bila stvar kupljena, ali pa zastopniku prodajalca, s katerim je sklenil pogodbo.

37.b člen

(1) Prodajalec ne odgovarja za stvarne napake na blagu, ki se pokažejo potem, ko mineta dve leti, odkar je bila stvar izročena.

(2) Če je predmet pogodbe med prodajalcem in potrošnikom rabljena stvar, ne odgovarja prodajalec za stvarne napake na blagu, ki se pokažejo potem, ko mine leto dni, odkar je bila stvar izročena.

(3) Šteje se, da je napaka na stvari obstajala že v času izročitve, če se pojavi v roku šest mesecev od izročitve.

37.c člen

(1) Potrošnik, ki je pravilno obvestil prodajalca o napaki, ima pravico od prodajalca zahtevati, da:

– odpravi napako na blagu ali

– vrne del plačanega zneska v sorazmerju z napako ali

– blago z napako zamenja z novim brezhibnim blagom ali

– vrne plačani znesek.

(2) V vsakem primeru ima potrošnik tudi pravico, da od prodajalca zahteva povrnitev škode, zlasti pa povračilo stroškov materiala, nadomestnih delov, dela, prenosa in prevoza izdelkov, ki nastanejo zaradi izpolnitve obveznosti iz prejšnjega odstavka tega člena.

(3) Pravice potrošnika iz prvega odstavka ugasnejo s potekom dveh let od dneva, ko je o stvarni napaki obvestil prodajalca.

Vrnjeni artikli

Vrnjeni artikli so artikli, ki so bili na Žicteh d.o.o. vrnjeni in imajo pomanjkljivosti (poškodovana embalaža, praske na ohišju, itd.). Tip pomanjkljivosti oziroma stanje artikla je zapisano ob posameznem artiklu in tudi na računu.

Zaradi tega je spremenjeno tudi obdobje garancije, ki je ravno tako zapisano ob vsakem artiklu iz kategorije ‘Vrnjeni artikli’ in tudi navedeno na računu.

Artiklov, ki so kategorizirani kot ‘Vrnjeni artikli’ ni mogoče vrniti in zamenjati za enak, nov artikel brez doplačila, možna pa je zamenjava za enak ali drug artikel enake vrednosti (ali z doplačilom razlike). V primeru nedelovanja artikla je stranka upravičena do odstopa od pogodbe v enakih rokih, kot veljajo za vse artikle ali garancijskega popravila.

Dostava

Ponudnik bo blago oziroma storitev dostavil v dogovorjenem roku.

Pogodben partner za dostavo pošiljk je dostavna služba Pošta Slovenije, vendar si ponudnik pridržuje pravico izbrati drugo dostavno službo, če bo s tem lahko naročilo izpolnil bolj učinkovito. Pošiljko je mogoče prevzeti tudi osebno na naslovu: Sedlašek 74, 2286 Podlehnik, Slovenija.

Ob dostavi kupec prejme račun in garancijski list. Navedene so vse potrebne informacije glede naslova, kamor se kupec lahko obrne v primeru pritožbe in informacije glede garancij ter servisa oziroma drugih storitev po zaključku pogodbe.

Ponudnik uporablja ustrezna tehnološka in organizacijska sredstva za zaščito prenosa in shranjevanja osebnih podatkov ter plačil.

Naša programska oprema, ki kot standard uporablja Secure Socket Layer (SSL).

Varovanje osebnih podatkov

Ponudnik se zavezuje k trajnemu varovanju vseh osebnih podatkov uporabnika v skladu z zakonodajo – Zakon o varstvu osebnih podatkov ZVOP-2, Ur. l. RS št. 94/07 in GDPR.

Ponudnik bo osebne podatke uporabil izključno za potrebe izpolnitve naročila (pošiljanje informativnega gradiva, ponudb, računov) in ostalo potrebno komunikacijo.

Uporabnikovi podatki v nobenem primeru ne bodo predani nepooblaščenim osebam. Po prenehanju potrebe po vodenju osebnih podatkov, se podatki izbrišejo oziroma se uničijo nosilci podatkov.

Za varovanje osebnih podatkov je odgovoren tudi uporabnik sam in sicer tako, da poskrbi za varnost svojega uporabniškega imena in gesla.

Google Analytics

Ta spletna stran uporablja Google Analytics. Google Analytics uporablja besedilne datoteke, ki se shranijo na vašem računalniku in omogočijo analizo uporabe spletne strani. Informacije o uporabi te spletne strani (vključno z vašim IP naslovom, pri čemer zaradi nijhovega sredstva anonimnosti „_anonymizeIp()“ zadnjih 8 znakov ni posredovanih na Google Analytics) ustvarjene s pomočjo piškotkov so prenesene in shranjene na Googlov strežnik v ZDA . Komunikacija

Ponudnik bo z uporabnikom stopil v stik preko sredstev komunikacij na daljavo le, če temu uporabnik izrecno ne nasprotuje.

Oglasna elektronska sporočila bodo vsebovala naslednje sestavine:

• jasno in nedvoumno bodo označena kot oglasna sporočila,

• pošiljatelj bo jasno razviden,

• različne akcije, promocije in druge tržne tehnike, bodo označene kot takšne. Prav tako bodo jasno določeni pogoji udeležbe v njih,

• jasno bo predstavljen način odjave od prejemanja oglasnih sporočil,

• željo uporabnika, da ne želi prejemati oglasnih sporočil, bo ponudnik izrecno spoštoval.

Odzivi uporabnikov

Odzivi uporabnikov ter recenzije izdelkov, ki jih kupci napišejo, so del funkcionalnosti trgovine, ki so namenjene skupnosti uporabnikov. Ponudnik omogoča, da mnenje napiše katerikoli uporabnik trgovine, pred dokončno objavo pa jih ponudnik pregleda. Ponudnik ne bo objavil mnenj oziroma prispevkov, ki so kakorkoli žaljivi, obsceni ali po mnenju ponudnika ne nudijo koristi drugim uporabnikom in obiskovalcem.

Z oddajo mnenja ali komentarja se uporabnik izrecno strinja s pogoji uporabe in ponudniku dovoljuje objavo dela ali celotnega teksta v vseh elektronskih in drugih medijih. Ponudnik ima pravico vsebino uporabljati časovno neomejeno in za katerikoli namen, ki je v poslovnem interesu ponudnika, vključno z objavo v oglasih ali drugih marketinških komunikacijah. Avtor mnenja hkrati izjavlja in zagotavlja, da je lastnik materialnih in moralnih avtorskih pravic za napisana mnenja in komentarje ter da te pravice ne izključno in časovno neomejeno prenaša na ponudnika.

Varstvo otrok

Oglasna sporočila bodo jasno razvidna (upoštevajoč starost) in jasno ločena od iger in tekmovanj. Vsaka komunikacija, namenjena otrokom, bo primerna njihovi starosti in ne bo izkoriščala zaupljivosti otrok, pomanjkanja izkušenj ali občutka lojalnosti.

Ponudnik ne sme sprejemati naročila od nekoga, za katerega ve ali sumi, da je otrok, ne da bi zato imel izrecnega dovoljenja njegovih staršev ali skrbnikov.

Ponudnik brez izrecnega dovoljenja njihovih staršev ali skrbnikov ne sme sprejemati kakršnihkoli osebnih podatkov, ki zadevajo otroke. Prav tako ponudnik tretji osebi ne sme izdajati podatkov, sprejetih od otrok, izjema so starši oziroma skrbniki.

Ponudnik ne sme ponujati prostega dostopa do izdelkov ali storitev, ki so škodljive za otroke.

Piškotki in druge tehnologije, ki jih uporabljamo

Piškotke in/ali podobne tehnologije uporabljamo za analizo vedenja strank, upravljanje spletnega mesta, sledenje gibanju uporabnikov in zbiranje informacij o uporabnikih. To naredimo zato, da prilagodimo in izboljšamo vašo izkušnjo z nami.

Piškotek je majhna besedilna datoteka, shranjena na vašem računalniku. Piškotki shranjujejo informacije, ki se uporabljajo za pomoč pri delovanju spletnih mest. Samo mi lahko dostopamo do piškotkov, ki jih ustvari naše spletno mesto. Svoje piškotke lahko nadzorujete na ravni brskalnika. Če se odločite za onemogočanje piškotkov, lahko to ovira vašo uporabo določenih funkcij ( primer: Brez funkcionalnih piškotkov ne bodo delovali nekateri procesorji plačil ).

Piškotke uporabljamo za naslednje namene:

  • Bistveni (nujni) piškotki – ti piškotki so potrebni, da lahko uporabljate nekatere pomembne funkcije na naši spletni strani, kot je prijava. Vedno vklopljeni. Odveza odgovornosti

Ponudnik se po svojih najboljših močeh trudi zagotoviti ažurnost in pravilnost podatkov, ki so objavljeni na njegovih straneh. Kljub temu, pa se lahko lastnosti artiklov, rok dobave ali cena spremenijo tako hitro, da ponudnik ne uspe popraviti podatkov na spletnih straneh. V takem primeru, bo ponudnik kupca obvestil o spremembah in mu omogočil odstop od naročila ali zamenjavo naročenega artikla.

Ponudnik ne odgovarja za vsebino mnenj o artiklih, ki jih napišejo obiskovalci. Ponudnik mnenja pred objavo pregleda in zavrne tista, ki vsebujejo očitne neresnice, so zavajajoča ali žaljiva. Ponudnik ne odgovarja za informacije v mnenjih in se odvezuje kakršnekoli odgovornosti, ki izvira iz informacij v mnenjih.

Pritožbe in spori

Ponudnik spoštuje veljavno zakonodajo o varstvu potrošnikov. Ponudnik se po vseh močeh trudi izpolnjevati svojo dolžnost vzpostaviti učinkovit sistem obravnavanja pritožb in določiti osebo, s katero se, v primeru težav, kupec lahko poveže telefonsko ali po elektronski pošti. Pritožba se odda prek e-poštnega naslova zicteh@gmail.com. Postopek obravnave pritožbe je zaupen.

Ponudnik bo v petih delovnih dneh potrdil, da je prejel pritožbo, sporočil kupcu, kako dolgo jo bo obravnaval in ga vseskozi obveščal o poteku postopka.

Ponudnik se zaveda, da je bistvena značilnost potrošniškega spora, vsaj kar zadeva sodno reševanje, njegova nesorazmernost med ekonomsko vrednostjo zahtevka in stroški, ki nastanejo pri reševanju samega spora. To je tudi glavna ovira, da potrošnik ne sproži spora pred sodiščem. Zato se ponudnik prizadeva po svojih najboljših močeh, da se morebitni spori rešijo sporazumno.

V primeru, da kupec/potrošnik ni zadovoljen z rešitvijo pritožbe lahko:

  1. v skladu z Zakonom o izvensodnem reševanju potrošnikih sporov (v nadaljevanju: ZlsRPS) vloži pobudo za začetek postopka izvensodnega reševanja konkretnega potrošniškega spora pri Evropskem centru za reševanje sporov (v nadaljevanju: ECDR), mat.št. 6108890000, s sedežem v Ljubljani, Tomšičeva ulica 6, ki ga ponudnik priznava kot pristojnega izvajalca za reševanje potrošniških sporov. ECDR je pri Ministrstvu za gospodarski razvoj in tehnologijo RS (v nadaljevanju: MGRT) registriran kot izvajalec izvensodnega reševanja potrošniških sporov in bo t.i. posredovalno-razsojevalni postopek (kombinacija mediacije in arbitraže), za katerega se je odločil ponudnik, izvajal v skladu s >Pravili ECDR o postopkih izvensodnega reševanja potrošniških sporov<, ki so objavljeni na spletni strani www.ecdr.si. Na ta način je kupcu/potrošniku zagotovljen hiter, enostaven in učinkovit način izvensodnega reševanja potrošniških sporov, saj je postopek zaključen praviloma v 30 dneh in je za kupca/potrošnika brezplačen (kupec/potrošnik krije zgolj stroške svojega morebitnega pooblaščenca). Pobuda za začetek postopka se vloži na obrazcu, ki je v elektronski obliki dostopen na spletni strani www.ecdr.si ali v papirni obliki na sedežu ECDR. Postopke izvensodnega reševanja potrošniških sporov vodijo nevtralni strokovnjaki, akreditirani pri ECDR, ki izpolnjujejo pogoje, predpisane z ZlsRPS in so vpisani v register izvajalcev pri MGRT.

Terms of Business

The general terms and conditions are compiled in accordance with the Consumer Protection Act (ZVPot).

The website www.gabione.si is managed by Žicteh d.o.o., an e-commerce service provider (hereinafter referred to as the "provider").

The general terms of business address the operation of www.gabione.si, user rights, and the business relationship between the provider and the customer.

Prices are valid at the time of order placement and do not have a predetermined validity.

Prices are valid in the case of payment with the above-mentioned payment methods, under the above-mentioned conditions. Despite extraordinary efforts to ensure the most up-to-date and accurate information, it may happen that the price information is incorrect. In this case, or if the price of the product changes during the processing of the order, the provider will enable the customer to withdraw from the purchase and will also offer a solution that will go in mutual satisfaction.

The sales contract between the provider and the customer is concluded at the moment the provider confirms the order (the customer receives an email about the status Order confirmed). From this moment, all prices and other conditions are fixed and apply to both the provider and the customer.

Purchase Process

How do I prepare an order?

When the order is placed, both the buyer and the provider receive the order details on their respective email addresses. The provider always contacts the client at the email or contact phone number provided by him to clarify the details, the correctness of the order and the delivery method. The contract for the purchase of ordered items between the buyer and the provider is irrevocably concluded at this stage.

The provider prepares and sends the goods within the agreed period. If the customer chooses delivery via Pošta, the courier always has the customer's phone number to inform him about the delivery time or any delays.

Right to Withdraw from Purchase, Return of Goods

The customer has the right to inform the company within 14 days of receiving the goods that he is withdrawing from the contract, without needing to state a reason for his decision. The message is considered timely if the shipment is posted within the deadline.

Unless the contracting parties have agreed otherwise, the consumer does not have the right to withdraw from the contract in relation to the following goods: - for goods made to order specifically for the customer.

The only cost borne by the consumer in connection with the withdrawal from the contract is the direct cost of returning the goods. The latter must be returned to the company no later than 14 days after the message of withdrawal. If the consumer has withdrawn from the contract, the company must return all payments made. The return of payments must be made by the company as soon as possible, no later than 14 days after receiving the message of withdrawal from the contract. The company may withhold payment until the returned goods are received or until the consumer sends proof that the goods have been sent back, depending on which event occurs first. If the company is late in returning the payments, the consumer must pay the consumer in addition to the statutory default interest, another tenth of the payments received for every completed 30 days of delay in returning.

The return of goods is possible in a preserved market condition (labels, original packaging, invoice), without signs of use (scratches, dirt, cracks, etc.). You must complete a survey for return/exchange of goods, which you can get here, and attach it to the goods when returning. The return is possible via Pošta Slovenije or in person (with prior notice by phone 06 861 1189) at the address: Žicteh d.o.o., Sedlasek 74, 2286 Podlehnik, Slovenia.

Warranty

Items have a warranty if this is stated on the warranty card or on the invoice. The warranty is valid following the instructions on the warranty card and presenting the invoice. Warranty periods are stated on the warranty cards or on the invoice.

Information on the warranty is also stated on the product presentation page. If there is no information about the warranty, the item does not have a warranty, or the information is not known at this time. In the latter case, the customer can contact the provider, who will provide up-to-date information.

Claiming a Material Defect

Article

(1) The seller must deliver the goods to the consumer in accordance with the contract and is responsible for material and legal defects in its performance.

(2) The defect is material:

it, which was known to the seller or should have been known to him;

if the thing does not have the properties necessary for its normal use or for trade;
2. if the thing does not have the properties necessary for the particular use for which the buyer buys it, which was known to the seller or should have been known to him;
  1. if the thing does not have the properties and virtues that were expressly or tacitly agreed upon or prescribed;
  2. if the seller has delivered a thing that does not match the sample or model, unless the sample or model was shown only for notification.
  3. (3) The suitability of the goods for normal use is assessed concerning ordinary goods of the same type and taking into account any statements about the characteristics of the goods made by the seller or manufacturer, especially by advertising, product presentation, or statements on the goods themselves.
  4. (4) The provisions of the law governing contractual relations apply to liability for material and legal defects if this law does not provide otherwise.
  5. Article 37.a
  6. (1) The consumer may claim his rights from a material defect if he notifies the seller of the defect within two months from the day the defect was discovered.
(2) The consumer must describe the defect in more detail in the notice of the defect and allow the seller to inspect the item.
(3) The consumer can notify the seller of the defect in person, in which case the seller must issue a certificate, or send it to the store where the item was purchased, or to the seller's representative with whom the contract was concluded.
Article 37.b
(1) The seller is not liable for material defects in the goods that appear after two years have passed since the item was delivered.
(2) If the subject of the contract between the seller and the consumer is a used item, the seller is not liable for material defects in the goods that appear after one year has passed since the item was delivered.
(3) It is considered that the defect in the thing existed at the time of delivery if it appears within six months of delivery.
Article 37.c
(1) The consumer who has properly notified the seller of the defect has the right to demand from the seller that:
  • corrects the defect in the goods or
  • returns part of the amount paid in proportion to the defect or
  • replaces the defective goods with new flawless goods or
  • returns the amount paid.
(2) In any case, the consumer also has the right to demand compensation from the seller, especially the reimbursement of costs for materials, spare parts, labor, transfer, and transportation of products that arise from fulfilling the obligations under the previous paragraph of this article.
(3) The consumer's rights under the first paragraph expire two years from the day he notified the seller of the material defect.
Returned Items
Returned items are items that have been returned to Žicteh d.o.o. and have defects (damaged packaging, scratches on the housing, etc.). The type of defect or condition of the item is written next to each item and also on the invoice.
Because of this, the warranty period is also changed, which is also written next to each item in the 'Returned Items' category and also stated on the invoice.
Items categorized as 'Returned Items' cannot be returned and exchanged for the same, new item without a surcharge, but it is possible to exchange for the same or another item of the same value (or with a surcharge of the difference). In the event of a malfunction of the item, the customer is entitled to withdraw from the contract within the same deadlines that apply to all items or warranty repair.
Delivery
The provider will deliver the goods or service within the agreed period.
The contractual partner for the delivery of shipments is the delivery service Pošta Slovenije, but the provider reserves the right to choose another delivery service if this will allow the order to be fulfilled more efficiently. The shipment can also be picked up in person at the address: Sedlašek 74, 2286 Podlehnik, Slovenia.
Upon delivery, the customer receives an invoice and a warranty card. All necessary information regarding the address to which the customer can turn in case of a complaint and information regarding warranties and service or other services after the conclusion of the contract are listed.

This is also the main obstacle for the consumer not to initiate a dispute before the court. Therefore, the provider makes every effort to resolve any disputes amicably.
If the buyer/consumer is not satisfied with the resolution of the complaint, they can:
in accordance with the Act on out-of-court resolution of consumer disputes (hereinafter: ZlsRPS) submits an initiative for the initiation of the procedure for the out-of-court resolution of a specific consumer dispute at the European Center for Dispute Resolution (hereinafter: ECDR), mat. no. 6108890000, with headquarters in Ljubljana, Tomšičeva ulica 6, which the provider recognizes as a competent contractor for resolving consumer disputes. ECDR is registered with the Ministry of Economic Development and Technology of the Republic of Slovenia (hereinafter: MGRT) as a provider of out-of-court resolution of consumer disputes and will be the so-called the mediation-adjudication procedure (combination of mediation and arbitration), which the provider decided on, was carried out in accordance with the >ECDR Rules on procedures for the out-of-court resolution of consumer disputes<, which are published on the website www.ecdr.si. In this way, the buyer/consumer is guaranteed a quick, easy and efficient way of resolving consumer disputes out of court, as the procedure is generally completed within 30 days and is free of charge for the buyer/consumer (the buyer/consumer only covers the costs of his potential representative). The initiative to start the procedure is submitted on a form that is available in electronic form on the website www.ecdr.si or in paper form at the ECDR headquarters. Procedures for the out-of-court resolution of consumer disputes are conducted by neutral experts accredited by ECDR, who meet the conditions prescribed by ZlsRPS and are entered in the register of contractors at MGRT.
